WARRANTY OF GOODS
Matairi Tyres (hereafter referred to as “the Company”) does not provide any warranties, express or implied, regarding the tyres or any associated products sold to the customer. All warranties, guarantees, and claims related to the products, including but not limited to performance, quality, or suitability for a particular purpose, are exclusively the responsibility of the manufacturer or supplier of the tyres.
-
No Responsibility for Defective Goods: The Company shall not be held liable for any defects, damages, or issues that may arise after the sale of the tyres. The customer acknowledges that any claims regarding defects, damages, or the quality of the tyres must be directed to the manufacturer or supplier of the tyres. The Company is not responsible for any cost or damage arising from the failure of any product sold.
-
Manufacturer/Supplier Liability: Any and all warranties or guarantees concerning the tyres and their use are exclusively provided by the manufacturer or supplier and are subject to their specific terms and conditions. The Company does not extend, modify, or accept any liability concerning these warranties or guarantees.
-
Claim Process: In the event that the customer seeks to make a claim regarding defects or dissatisfaction with the tyres, such claims must be handled directly with the manufacturer or supplier. The Company does not accept or process claims for defective products. Any communication, claims, or warranties must be pursued by the customer with the tyre manufacturer or supplier, and not with the Company.
-
Limitation of Liability: The Company’s liability for any claim, damage, loss, or injury, including those arising from a defect or non-conformance of the tyres, shall be strictly limited to the purchase price of the tyres. Under no circumstances will the Company be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the tyres.
-
Exclusion of Implied Warranties: The Company explicitly disclaims all implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. The customer agrees to hold the Company harmless from any claims, damages, or losses related to the tyres or any use thereof.
-
Indemnity: The customer agrees to indemnify and hold the Company harmless from any claims, damages, or losses, including legal fees, arising from any dispute with the manufacturer, supplier, or any third party related to the tyres.
By purchasing tyres from Matairi Tyres, the customer acknowledges and accepts these terms, understanding that any warranty or claim for defective tyres must be pursued with the manufacturer or supplier, and not with the Company. The customer further acknowledges that Matairi Tyres shall not be responsible for any claims, damages, or liabilities related to the tyres purchased.
